AGREEMENT BETWEEN COs TO GET PREFERENCE DURING ARBITRATION
The Supreme Court has ruled that
in the settlement of a company
dispute, the agreement between the
concerned parties detailing a procedure
to appoint arbitrators has to be
given preference.
A Bench comprising Justices GP Mathur
and LS Panta said the aggrieved party
cannot move a judicial forum except
under certain contingencies provided
under arbitration law.
